JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 24-01-2022 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. Learned counsel for the petitioners undertakes to remove the defects within four weeks of normal court proceedings. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioners apprehend their arrest in Amarpur (Fullidumar O.P.) P.S. Case No.386 of 2020, registered for the offences punishable under Sections 341, 323, 308, 354, 379, 504, 506 and 34 of the Indian Penal Code.

No.10325 of 2021(3) dt.24-01-2022 2/3 The petitioners and other accused persons are said to have abused and assaulted the informant by means of different weapons due to which the informant sustained head injuries. When the wife of the informant came to save, she was also assaulted by the petitioners by means of khanti and lathi. The accused persons snatched chain and ring made of gold from the wife of the informant. The accused persons also snatched mobile phone of the wife of the informant.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. There is case and counter case between the parties. It is further submitted that the injuries sustained by the informant is simple in nature. There is no injury report of the wife of the informant in the case diary. It is further submitted that the petitioners were given benefit of Section 41(1) of Cr.P.C. The petitioners have got no criminal antecedent as stated in para 3 of the bail application.
Taking into consideration the facts that the injuries sustained by the informant is simple in nature and petitioners have got no criminal antecedent, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on

No.10325 of 2021(3) dt.24-01-2022 3/3 bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur (Fullidumar O.P.) P.S. Case No.386 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
