The petitioner seeks bail in Kotwali P.S. Case No. 865 of 2018, instituted for the offence under Section(s) 448, 386 and 387/34 of Indian Penal Code.

It is alleged in the written report that six persons armed with firearms came at the shop of the informant by three Motorcycles. At that time Kamal Daruka was present at his shop. Out of six accused persons, the informant identified two veteran criminals as Pappu Sonar and Baban. It is further alleged that accused persons made demand of extortion money of Rs.5,00,000/-. They snatched Rs.60,000/- from the informant. Counsel for the petitioner submits that petitioner is

Patna High Court CR. MISC. No.51163 of 2019(2) dt.21-08-2019 2/2 not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused. Petitioner was arrested by the Police merely on suspicion in Kotwali P.S. Case No. 4 of 2019. Police recorded the confessional statement of petitioner in that case and remanded him in the instant case.

Petitioner is in custody since 18.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali P.S.
