====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

The informant alleges that on 16.01.2020, at around 11:00 am, when her husband came back from the market, the accused persons including the petitioner came and assaulted him leading to his death.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2022, is a women and is a person with clean antecedent.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that one person has died and there is allegation of assault by the accused persons. Considering the submissions made by the learned counsel for the petitioner and the fact that petitioner is a women which persuades this Court to enlarge the petitioner on bail. Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Piprakothi P.S. Case No. 22 of 2020.
