JUSTICE HEMANT GUPTA ORAL ORDER 06-10-2016 The present is an application for grant of anticipatory bail under Section 438 of the Code of Criminal Procedure to the petitioner in respect of Buxar (I) P.S. Case No. 8 of 2016 dated 16.01.2016 registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code. The argument of learned counsel for the petitioner is that the petitioner is not named in the F.I.R. A perusal of the impugned order passed by Additional Sessions Judge, Buxar shows that during investigation, the role of the petitioner has been found in causing death to Ajit Kumar.

Since the matter is still under investigation, I do not find any case is made out for grant of anticipatory bail. Accordingly, the present application is dismissed. (Hemant Gupta, J) Mishra/- U T
