Petitioners seek bail in a case registered for the offences punishable under Sections 341, 323, 324, 325, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners were on bail during investigation of this case, considering the merit of allegation. However, subsequently, the offence under Section 304 of the Indian Penal Code was also added and after addition the bail bonds of the petitioners were canceled on 24.01.2019, without giving opportunity of hearing. Thereafter, petitioners filed a petition for bail and prayer for bail

Patna High Court CR. MISC. No.52354 of 2019(2) dt.26-08-2019 2/2 was refused on 10.07.2019.

Finding substance in the aforesaid submission, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Marauna Police Station Case No.55 of 2011, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
