Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Kusheshwar Asthan P.S. Case No. 222/2020 instituted for the offences under Sections 147, 341, 323, 307, 379, 427, 504 and 34 of the Indian Penal Code.

He is said to have assaulted the informant on his head leading to grievous injuries on his person. The learned counsel for the petitioner has submitted that the occurrence arose out of a trifle and there is a counter version of the occurrence as well. Someone

Notwithstanding the afore-note facts, I am not inclined to grant anticipatory bail to the petitioner for the reason that he has caused grievous injury to the victim. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court below and seeks bail, that petition shall be considered on its own merits without being prejudiced by the fact that the present petition on his behalf has not been entertained.
