The petitioner is in custody since 7.7.2014 in connection with Jogbani (Bathnaha) P.S. Case No.70/14 for the offences under Sections 364/34, 302,201/34 of the I.P.C. It is submitted on behalf of the petitioner that though the allegation against the petitioner in the F.I.R., the confessional statement of the main accused in the case made before the police reveals that the petitioner at best had been arrested in course of disposal of the dead body being carried.

Learned counsel for the informant submits that the petitioner is the brother-in-law of the accused persons who had participated in the murder of the family members and the

It is further submitted that the petitioner is said to have assisted them in concealing the dead body of the deceased persons. However, considering the period of custody and also the fact that the petitioner has been named on suspicion alone in the F.I.R. and that he has no criminal antecedent , let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., Araria, in Jogbani (Bathnaha) P.S. Case No.70/14.
