JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-07-2022 Heard learned counsel for the petitioners and learned APP for the State and perused the case diary. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

The prosecution case in short is that a truck of the informant was standing in the garage of one Kundan for its body repairing and accused persons including the petitioners brought his truck to their home and replaced its registration plate and when the accused persons were going to sell the said vehicle of the informant it was recovered from the possession of accused persons including the petitioners.

Patna High Court CR. MISC. No.63304 of 2021(3) dt.12-07-2022 2/2 It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that the truck in question of the informant was also stolen and this regard Khizersarai P.S. Case No. 116 of 2019 had been lodged as the informant was running his truck by changing the number plate of the truck.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-VIII, Gaya in connection with Buniyadganj P.S. Case No. 69 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
