The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353, 504 and 506 of the Indian Penal Code. The prosecution case is that the police went to arrest Gedan Manjhi, son of Gullo Manjhi in connection with Banka (Panjwara) P.S. Case No. 269 of 2014 when Gedan Manjhi was arrested, the mob including the petitioners got aggressive and started pelting bricks and got released Gedan Manjhi from the custody of the police.

It is submitted by learned counsel for the petitioners that the ordersheet of learned CJM, Banka reflects that Gedan Manjhi and his father namely Gullo Manjhi both were directed to

Patna High Court Cr.Misc. No.38466 of 2015 (2) dt.28-09-2015 2/2 be released on bail and they furnished their bail bonds on 15.05.2015 in connection with Banka (Panjwara) P.S. Case No. 269 of 2014 whereas the informant claims to have in the said case on 24.05.2015. Moreover, accusation is omnibus and general and statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Banka (Panjwara) P.S. Case No.317 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
