Petitioners apprehend their arrest in Falka (Pothia) P.S. Case No.141 of 2019 registered under Sections 363, 366 and 34 of the Indian Penal Code.

The father of the victim alleged that his married daughter had gone to Central Bank of India but she did not return. In course of search, the informant came to know that Santosh Kumar kidnapped the married daughter of the informant. It is further alleged that the petitioners also helped

Learned counsel for the petitioners submits that the petitioners are father, brother and uncles of Santosh Kumar. The victim is a married woman and on account of love affairs, she herself fled away with Santosh Kumar and both are leading conjugal life.

Having considered the facts and the nature of allegation made against the petitioners and the fact that the petitioners are father, brother and uncles of Santosh Kumar, who is said to have kidnapped the married daughter of the informant, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Katihar in connection with Falka (Pothia) P.S. Case No.141 of 2019, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
