The petitioners seek bail in a case instituted for the offences under Sections 25(1-B)a, 26 and 35 of the Arms Act. Prosecution case, in short, is that one loaded country made pistol and one live cartridge are recovered. It has been submitted on behalf of the petitioners that the petitioner no. 1 has got no criminal antecedent. Chargesheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that one loaded country made pistol is recovered from the possession of the petitioner no. 1 and one live cartridge is

Patna High Court CR. MISC. No.50466 of 2019(2) dt.16-08-2019 2/2 recovered from the possession of petitioner no. 2. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Saharsa in connection with Salkhua P.S. Case No. 29 of 2019.
