JUSTICE RAKESH KUMAR ORAL ORDER 05-09-2016 Heard Sri Vinit Kumar, learned counsel, who was assisted by Sri Pankaj Kumar, learned counsel for the petitioner and Sri Jitendra Kumar Singh, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Bihar P.S. Case No.148/2016 registered for the offence under Sections 467, 468, 471, 420/34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest.

By way of referring to F.I.R., learned counsel for the petitioner submits that the petitioner was dealing with land and in a sale deed, which was got registered in favour of the informant, vendor was one Bibi Asgari Khatoon and the petitioner stood as witness. He further submits that the petitioner was not having any

Patna High Court Cr.Misc. No.34509 of 2016 (2) dt.05-09-2016 2/2 knowledge as to whether the vendor had earlier transferred the said land to her husband. He submits that the petitioner being a land broker, he stood as identifier, which was got registered in favour of the informant.

Keeping in view the nature of accusation, let the petitioner, namely, Md. Sharjeel Ahmad @ Sharjeel Ahmad @ Chand, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Bihar P.S. Case No.148/2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
