The petitioner seeks bail in Cheriya Bariyarpur P.S. Case No. 116 of 2018 instituted for the offence under Sections 323, 379, 907, 498(A), 313, 314, 406, 504 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Counsel for the petitioner submits that although there is allegation that petitioner has performed second marriage but reality is that he has not performed second marriage. He is in custody since 24.8.2018 having clean antecedent. From the written report it appears that general and omnibus allegation has been levelled against the petitioner. Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.74077 of 2018(3) dt.18-12-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Manjhaul, Begusarai, in connection with Cheriya Bariyarpur P.S. Case No. 116 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
