The petitioner, being the owner of the vehicle, which has been seized by the police in connection with Koilwar P.S. Case No.10 of 2014, has been in custody since 19.9.2014. It is submitted on behalf of the petitioner that certain bags of rice were found kept in the plot of one Ravikant Dubey and the petitioner's vehicle was found parked near the Gidha Industrial Area. It is submitted that suspecting that the petitioner's vehicle might have been used for carrying the said rice to the said plot, the petitioner's vehicle has been seized. It is further submitted that the bags of rice, which were recovered from the godown, were also seized. It is submitted that the Guard of the
Patna High Court Cr.Misc. No.46431 of 2014 (4) dt.16-02-2015 2/2 godown, who has been specifically named in the F.I.R., has been extended the privilege of anticipatory bail in Cr.Misc. No.33405 of 2014, vide order dated 12.8.2014, whereas this petitioner, whose vehicle was parked near the said plot, has been arrested and is languishing in jail.
Considering the aforementioned submissions and the facts that there is no specific allegation against the petitioner and the petitioner, being the owner of the vehicle, was taken into custody though the truck was empty and also the fact that the petitioner has no criminal antecedents, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur (Arrah), in connection with Koilwar P.S. Case No.10 of 2014.
