The petitioners apprehend their arrest in Haspura P.S. Case No. 77/2016, registered for the offences punishable under Sections 366A, 504 and 34 of the Indian Penal Code. The informant alleged that his minor daughter went to attend the call of nature, but she did not return. During the course of search the informant came to know that the petitioners, Kashi Sao and Prince Kumar kidnapped his minor daughter. It is submitted that the victim made her statement under Section 164 of the Cr.P.C. She disclosed her age 19 years, She further disclosed that she voluntary left her house called Prince Kumar and thereafter they went to Patna where they
Patna High Court Cr.Misc. No.32165 of 2016 (3) dt.16-09-2016 2/2 solemnized marriage in a temple.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 77/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
