State.
Petitioner is an accused in a case under Section 302/34 of the Penal Code. He is named in the First Information Report along with one Manoj Singh, five others. From the tenor of the First Information Report lodged by the wife of the deceased, it is quite evident that Manoj Singh with the assistance of the petitioner, five others assaulted the husband of the deceased and after he became injured, confined him in his house and while being taken to the hospital, husband of the informant died. It is submitted on behalf of the petitioner that there being two lacerated wound on the head of the deceased, all the persons named in the First Information Report cannot be attributed with those injuries. Patna High Court Cr.Misc. No.46867 of 2014 (3) dt.04-03-2015 2/2 has been noted only for being rejected as from the tenor of the First Information Report it is quite evident that the petitioner, five others including Manoj Singh are responsible for the murder of the husband of the informant.
