JUSTICE BIRENDRA KUMAR ORAL ORDER 02-02-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 324/34 of the Indian Penal Code.

Allegation against the petitioners is of commission of assault and tooth bite. Allegation, of commission of injury at the head of the informant, is against the petitioner no. 2 Dimpal Das @ Deepal Das. The Doctor has found simple injury on the injured. There is no allegation of repetition of blow. The petitioners have stated on oath that they have got no criminal antecedent and submission is that they will fully co-operate with the investigation and trial of the case.

No.30050 of 2016 (4) dt.02-02-2017 2/2 Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Bhagalpur/Successor Court in connection with Sabour Police Station Case No. 87 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
