JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468 and 471 of the Indian Penal Code.

The prosecution case is that as per written report of Circle Officer, Kumarkhand to the effect that the petitioner and others applied for loan on the basis of forged Khatian, rent receipt and the land possession documents.

It is submitted by the learned counsel for the petitioner that the petitioner never applied for loan on the basis of alleged forged documents nor any loan was granted to him. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that similarly situated

Patna High Court Cr.Misc. No.38817 of 2015 (2) dt.01-10-2015 2/2 co accused Rita Kumari has been granted anticipatory bail vide Cr. Misc. No. 35590 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Madhepura in connection with Kumarkhand P.S. Case No.189 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
