JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-05-2017 Heard learned counsel for the petitioners and learned APP for the State.

The present application has been filed for quashing of the order dated 29/03/2014, passed by the learned CJM, Buxar (Mufassil), in connection with Buxar (M) P.S. Case No.32 of 2014 (G.R. No.278 of 2014), whereby, process has been directed to be issued after cognizance being taken for the offences punishable under sections 147, 323, 379 of the Indian Penal Code and section 27 of the Arms Act.

It is submitted by learned counsel for the petitioners that the accusation has been levelled in the background of the fact that at earlier point of time petitioner no.3 Ravindra Pathak filed Buxar (M) P.S. Case No.31 of 2014 against the informant of the present case. The accusation has also been levelled in the

Patna High Court Cr.Misc. No.35440 of 2016 (4) dt.25-05-2017 2/2 background of Title Suit No.72 of 2008.

This court is not inclined to interfere at this stage. However, it is expected from the learned trial Court to consider the contentions of the petitioners while considering the application for discharge.

Accordingly, the application is disposed of.
