ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 30.6.2014 in K.Nagar (Champanagar) P.S. Case No.333/14 for the offence under Sections 395, 397 of the I.P.C., 27 of the Arms Act and 3⁄4 of the Explosive Substance Act.

It is submitted on behalf of the petitioner that he was not named in the F.I.R. but subsequently on the basis of some secret information by spy the petitioner was taken into custody and his house hold articles were recovered from his house. It is further submitted that the said articles was, in fact, of common use and the same did not belong to any other. He further submits that the said allegation would be subject matter of further investigation

Patna High Court Cr.Misc. No.45429 of 2014 (3) dt.03-03-2015 2/2 and leading to evidence during trial.

Considering the aforementioned submissions and the period of incarceration and that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Purnea, in K.Nagar (Champanagar) P.S. Case No.333/14.
