Petitioner is said to have opened fire causing fire arms injury to the informant on his back but submission on behalf of the petitioner is that the Investigating officer could not collect injury report and submitted charge sheet without obtaining injury report. The learned trial court vide letter no. 315 dated 18.2.2015 has also reported that according to officer-in-charge of Sultanganj police station, no document regarding treatment of injured of this case was found in PMCH.

Moreover, petitioner is in jail custody since 15.2.2014 and he does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
