JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. The petitioners seek bail in connection with Simri P.S. Case No. 90 of 2021 instituted for the offences under Sections 420, 467, 468, 414 and 34 of the Indian Penal Code read with Sections 30(a) and 41 (i) (ii) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioners submits that the petitioners are in custody since 24.03.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.63355 of 2021(2) dt.04-02-2022 2/2 allegation is of recovery of 4232.46 litres of liquor from a truck. Learned counsel for the petitioners submits that the petitioners are driver and cleaner of the truck and thus were not knowing what was loaded in the truck by the owner. Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 24.03.2021, charge-sheet has been submitted in the case and the petitioners are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise), Darbhanga in connection with Simri P.S. Case No. 90 of 2021 with a condition that one of the bailor of both the petitioners shall be the brother of the petitioner no.1 (Sandeep Kumar).
