JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Karpi(Sahar Telpa) P.S. Case No. 8 of 2019 registered for the offences punishable under Sections 409, 420 of the Indian Penal Code and Section 7 of E.C. Act. Case has been lodged by Prakhand Vikash Padadhikari on the allegation that on verification of PDS of the petitioner it was found several irregularities, including that of not maintaining the cash memo and also not supplying the beneficiaries the articles.

Submission of learned counsel for the petitioner is that FIR itself shows that the statement of beneficiaries has been taken and most of them have supported that they have taken the articles and some of them are taking more rice leaving wheat and some of them are taking more wheat leaving rice, as such he

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Arwal, in connection with Karpi (Sahar Telpa) P.S. Case No. 8 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to appear before the I.O. as and when required.
