JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Complaint Case No. 3098 of 2012 corresponding to Tr. No. 1385 of 2015, disclosing offences under Sections 344 and 365 of the Indian Penal Code.
Considering the fact that the petitioners took steps for grant of anticipatory bail, nearly three years after institution of the complaint case, I am not inclined to entertain this application. I direct the petitioners to surrender before the court below within
Patna High Court Cr.Misc. No.39110 of 2015 (2) dt.28-09-2015 2/2 two weeks from today and seek regular bail if so advised. If they do so, the court below shall consider the prayer for regular bail on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
