The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 149, 341, 323, 325, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, it is stated that in the fight between Ramashankar Bind and Basant Bind, on Jagdish Bind going to settle the dispute, the eleven named accused persons variously armed with danda, iron rod, stone etc. assaulted as a result of which he fell down unconscious and was taken to the hospital for treatment.
It is submitted by learned counsel for the petitioner that the injured died in course of treatment and subsequently section 302 of the Indian Penal Code was added. The allegations
Patna High Court CR. MISC. No. 63346 of 2021(2) dt.15-04-2022 2/2 are general and omnibus in nature. The petitioner is in custody since 27.8.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of the allegation in the FIR together with the petitioner having remained in custody for more than 7 months and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Kudra P.S. Case no. 78 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Kaimur at Bhabua.
