JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-02-2015 In this case supplementary affidavit has been filed. Heard learned counsel for the petitioner, the learned A.P.P. as well as learned counsel for the Vigilance. This is an application for bail for the offences punishable under sections 7/ 13(2) read with section 13 (1) (D) of the Prevention of Corruption Act, 1988.

The petitioner was apprehended with taking bribe of Rs. 8,000/- and for that he is in custody since 27.08.2014. Submission is that in an identical case one Ram Dular Paswan has been allowed bail by another Bench of this Court Vide Cr. Misc. No. 43491 of 2014 by order dated 27.01.2015 and as

In this case charge sheet has already been submitted and there is no chance of tampering with the prosecution witnesses. In the facts and circumstances as stated above, petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Trap, Patna in Spl. Case No. 55 of 2014/ Vigilance Patna P.S. Case No. 057 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
