In this case, the petitioners are seeking anticipatory bail in connection with Industrial Area P.S. Case No. 73 of 2019, registered for the offence punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. It has been alleged that on the fateful day while the

Patna High Court CR. MISC. No.51016 of 2019(2) dt.17-08-2019 2/3 informant was taking dinner, he received a call from Sampat Kumar & Bikky, who started abusing the informant on the phone. When the reason was being questioned, he disconnected the call and after five minutes said Sampat Kumar along with Shiv Kumar @ Citi, Rahul Kumar, Piyush Kumar and Kashinath arrived at the informant's house and started assaulting the informant.

No specific allegation has been made against these petitioners and the injury sustained by the informant is shown to be simple in nature.

Looking to the aforesaid facts, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Industrial Area P.S. Case no. 73 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
