The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.
The prosecution case is that on suspicion the police signal two motorcycle born miscreants to stop, but they started fleeing away leaving the motorcycle on road. Subsequently it transpired that the alleged motorcycle being stolen one was used by Md. Alam and Saddam. It is submitted by the learned counsel for the petitioner that the father of the petitioner lodged Complaint Case No. 364 of 1990 against the Officer-in-charge of Haspura namely Mr. Alauddin Khan and in the said case cognizance was
Patna High Court Cr.Misc. No.37739 of 2015 (3) dt.28-09-2015 taken and date was fixed on 05.10.2015 for evidence, hence at the instance of the then Officer-in-charge the present Officerin-charge lodged the present case merely on suspicion. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 61 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
