JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-02-2022 Heard Mr. Raj Kukmar, learned Advocate for the petitioner and Ms. Pushpa Sinha, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kodhobari P. S. Case No. 14 of 2020, dated 17.07.2020, instituted for the offences under Sections 380, 354, 506 and 34 of the Indian Penal Code. One Asharaful, an associate of the petitioner, is alleged to have attempted to molest the informant whereas the petitioner and another were standing guard in front of the gate of the room of the informant. No.11111 of 2021(2) dt.22-02-2022 2/3 submitted that the accusation is absolutely false, in as much as the petitioner is the resident of the same village and locality as that of the informant. It appears to be rather improbable that he would associate himself in this act without concealing his identity.

Apart from this, it has been urged that there is no accusation against him of even attempting to molest the informant or anybody else.

Regard being had to the vague nature of accusation and taking into account that the petitioner does not have criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Kishanganj, in connection with Kodhobari P. S. Case No. 14 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
