2. The petitioners are in custody in connection with Mali P.S. Case No. 43 of 2023 for the offence under Sections 341, 323, 337, 338, 307, 504, 506, 34 of the Indian Penal Code.

3. As per prosecution, deceased was brutally assaulted on the shop of the accused persons after he had an altercation with the petitioners. In course of treatment, the deceased had died after 1 and 1⁄2 months. From the postmortem report, it appears that the deceased was brutally assaulted and has sustained several injuries in his head which is the cause of death.

4. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in

Patna High Court CR. MISC. No.56571 of 2023(2) dt.30-08-2023 2/2 custody since 03.07.2023.

5. In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the prayer of bail of the petitioner is rejected herewith.
