The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 324, 379, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, the five named accused persons are said to have come variously armed and it is further stated that the petitioner assaulted Bachu Singh on his head with the Dab.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The manner of occurrence is other than what has been narrated in the FIR, the correct version having been narrated in the FIR lodged by the petitioner himself which is Annexure-2 to the petition. The parties are agnates and the dispute was as a result of land

Patna High Court CR. MISC. No.63743 of 2021(4) dt.28-04-2022 2/2 dispute. Even as per the prosecution case there is no repetition of blow. The petitioner is in custody since 13.9.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the case and counter case between the parties, the petitioner having remained in custody for 7 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Sahiyara P.S. Case no. 4 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi.
