Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 16, 17, 18, 20, 23 of the Prevention of Unlawful Assembly Act. The prosecution case is that the informant being a teacher of Government school received unanimous mobile call demanding extortion of Rs. 1.5 lakhs and similar extortion demand was received through letter.

It is submitted by the learned counsel for the petitioner that First Information Report was registered against unknown as only mobile number 8226837394 has been mentioned in the F.I.R. The name of the petitioner sprang up on the confession of co-accused Aman Kumar Bind, Manish Kumar Keshri, Kirani Bind @ Kirani Singh and Rahul Kumar @ Rahul Bind.

Patna High Court Cr.Misc. No.35725 of 2016 (2) dt.02-09-2016 It is further submitted that there is no recovery from the petitioner. The petitioner is accused in one other case being Sangrampur P.S. Case No. 33 of 2010 registered under Sections 323, 504, 341/34 of the Indian Penal Code, but he is on bail. Moreover, similarly situated co-accused persons have been granted regular bail vide Cr. Misc. No. 14699 of 2016, 13011 of 2016, 12102 of 2016 and 11897 of 2016. In the circumstances, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kharagpur P.S. Case No. 08 of 2016, pending in the court of learned Sub-Divisional Judicial Magistrate, Munger.

With the above observation this application is disposed of.
