The petitioner prays for anticipatory bail in Nawada P.S. Case No.357/2016 registered for the offence under Section 272, 273 of the Indian Penal Code and Sections 47/54 of the Bihar Excise( Amendment ) Act,2016.

The allegation is that a huge quantity of 415 bottles of India Make Foreign Liquor was recovered from a vehicle. The petitioner and one another accused, it is alleged, on seeing the police vehicle, succeeded in fleeing away from there. A stand has been taken by the petitioner that he is only the owner of the vehicle and not occupier. The learned Sessions Judge has rejected the prayer for anticipatory bail considering the seriousness of the matter,

Patna High Court Cr.Misc. No.36125 of 2016 (4) dt.18-11-2016 2/2 where huge quantity of India Make Foreign liquor was being transported.

In my view, the petitioner does not deserve anticipatory bail. The prayer for anticipatory bail is rejected. (Kishore Kumar Mandal, J) NKS/- U T
