The petitioner has filed the present writ petition under Article 226 of the Constitution of India seeking a direction to the respondents that Panchayat Bhawan of Bishanpur Gram Panchayat in the district of Katihar should not be allowed to be constructed over the land donated by one Ram Kumar Devi, the mother of the then Mukhiya.

From the materials available on the record, this Court finds that during the pendency of the writ petition, Panchayat Bhawan for Gram Panchayat in question has already been constructed.

In above view of the matter, this Court is of the opinion that the present writ petition has become infructuous. It is
