The petitioner is in custody since 7.11.2013 in connection with Raxaul P.S. Case No.321 of 2013 registered for the offences under Sections 399, 400, 402, 414 of the Indian Penal Code and Sections 25(1-b)a 26/35 of the Arms Act and Sections 3/4 of the Explosive Substances Act.

It is submitted on behalf of the petitioner that as alleged, one country-made pistol was recovered. It is further submitted that co-accused Mukesh Kumar Gupta has been extended the privilege of bail in Cr.Misc. No.28183 of 2014, vide order dated 15.9.2014. Considering the aforementioned submissions and also the fact that the petitioner has been in custody since 7.11.2013,

Patna High Court Cr.Misc. No.46523 of 2014 (3) dt.16-02-2015 2/2 let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, in connection with Raxaul P.S. Case No.321 of 2013 (Tr. No.2976/2014).
