====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Special Case No. 9235 of 2018 arising out of Khajekalan P.S. Case No. 355 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition Act, 2016.

Counsel for the petitioner submits that there is no recovery of any liquor from conscious possession of the petitioner. In the written report it is mentioned that recovery has been made from Gali No. 3 (Mittan Ghat) in Adarsh Colony.

Petitioner is in custody since 2.10.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.72579 of 2018(2) dt.06-12-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Excise Act, Patna, in connection with Special Case No. 9235 of 2018 arising out of Khajekalan P.S. Case No. 355 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
