Mr.Rina Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-08-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Karakat P.S. Case no. 66 of 2019, registered under Sections 341, 323, 308, 452 and 504/34 of the Indian Penal Code.

The accusation is that at about 10.00 P.M. in the night of 21.03.2019, the informant was at his roof, at that time, six persons named in the F.I.R., including the petitioners, entered in the house of informant and started to abuse and cause assault to the informant his wife and daughter in law. At

Patna High Court CR. MISC. No.49605 of 2019(2) dt.08-08-2019 2/2 that time, they also snatched golden chain from the neck of daughter in law of the informant.

Learned counsel for the petitioners submits that, in fact, on the occasion of Holi, informant created obstruction due to that reason, the occurrence of Marpit took place in which petitioners' side also sustained injury regarding which Karakat P.S. Case No. 65 of 2019 was instituted against the informant and his other family members on 22.03.2019. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Bikramganj (Rohtas) in connection with Karakat P.S. Case No. 66 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
