The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The informant alleged that he purchased a Tata Magic vehicle after taking loan from the financier but on account of illness of his wife he could not pay the installments to the financier. Thereafter, the informant sold the petitioner on agreement that the petitioner shall pay installments to the financier, but the financier informed the informant that the petitioner was not paying the installments.
It is submitted that the agreement is forged and
Patna High Court Cr.Misc. No.37064 of 2015 (3) dt.06-11-2015 2/2 fabricated. The petitioner did not enter into an agreement with the informant. The petitioner purchased the vehicle after payment of the entire price.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Sakra P.S. Case No. 97 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
