JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Deepnagar P.S. Case No. 160 of 2014 registered for the offences punishable under Sections 306/34 of the Indian Penal Code. Allegedly, the daughter of the informant was married ten years ago with the son of the petitioner and she committed suicide after being harassed by the conduct of the petitioner and others. It is submitted that in this case chargesheet has already been submitted and there is no chance of tempering with the prosecution evidence and it is admitted fact that the deceased committed suicide, and as such, the petitioner deserves

Patna High Court Cr.Misc. No.47109 of 2014 (2) dt.04-02-2015 sympathetic consideration to which the learned APP does not dispute.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 160 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
