2. The petitioner who apprehends arrest in connection with G.R. No. 4811/2024 arising out of Lohiyanagar P.S. Case No. 115 of 2024 lodged on 03.11.2024, for the offences punishable under sections 126(2)/115(2)/323(2)/308(4)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution, the F.I.R. has been lodged against two named accused persons, including the petitioner, alleging that they stopped the informant's e-rickshaw and, at gunpoint, snatched 4,000/- from the informant and a gold ₹ chain from the informant's nephew.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. From the

No.50889 of 2025(2) dt.11-08-2025 2/3 contents of the F.I.R., it is evident that the alleged occurrence took place on 01.11.2024 at about 8:30 a.m., whereas the F.I.R. was lodged on 03.11.2024 at 6:10 p.m. The delay in lodging the F.I.R., according to the petitioner, casts serious doubt on the prosecution's case and indicates the modus operandi of the informant. The petitioner has specifically pleaded that the informant, along with one Rajendra Sah, had taken a loan of 25,000/- from the petitioner. As the petitioner was pressurizing ₹ Rajendra Sah and the informant to return the said loan amount, they, with a view to misappropriate the same, have lodged the present case with false and frivolous allegations. The petitioner is also accused in one other criminal case.

5. Learned APP for the State opposes the prayer for bail.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) as mentioned in Section 2(1) (d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 to the satisfaction of the learned CJM, Begusarai, in connection with G.R. No. 4811/2024 arising out of Lohiyanagar P.S. Case No. 115 of 2024, subject to the
