JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-10-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
Allegedly, it is a case of theft of a motorcycle of the informant which was recovered from the house of this petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the theft motorcycle was purchased from the co-accused Arvind Kumar and in this juncture, Annexure-2, which is an agreement, has been filed.
Learned APP appearing for the State opposed the
Patna High Court CR. MISC. No.63678 of 2021(4) dt.13-10-2022 2/2 anticipatory bail and submitted that the stolen motorcycle was recovered from the house of this petitioner and seizure list as mentioned at para-37 of the case diary shows this fact. After considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is rejected.
