Mr. Anjani Kumar Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-01-2023 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.
Heard learned counsel for the petitioners as well as the learned counsel for the informant.
The petitioners apprehend their arrest in connection with Sakatpur P.S. Case No. 62 of 2021, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 308, 337, 504 and 506 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that the FIR shows itself that there was election rivalry between both the parties. He has submitted further that the specific allegation of assault by iron rod on the head of informant was on co-accused Awadhesh Paswan and not on the petitioners. He has further submitted that there is case and counter case and both the parties have sustained injuries.

He has submitted that the accused persons have criminal antecedents as disclosed in paragraph No. 3 of the bail petition to which the learned counsel for the petitioners has submitted that these cases are of trivial nature and almost all the sections are bailable.
It appears that there is rivalry between the parties due to election. There is case and counter case.
Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Benipur, Darbhanga in connection with Sakatpur P.S. Case No. 62 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
