ANJANA MISHRA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Sahebpur Kamal P.S. Case No.159 of 2013 for allegedly having committed the offence under Section 302/34 of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that the petitioner has been named in connection with the present case only on the basis of suspicion as some of the witnesses have stated that the deceased was last seen with a few persons, including this petitioner.
Learned counsel for the State submits that it appears
Patna High Court Cr.Misc. No.36633 of 2015 (3) dt.15-12-2015 2 / 2 from the post-mortem report that the deceased was found to have been drowned and death has been caused due to asphyxia by drowning. It is also submitted that in some of the paragraphs of the case diary, certain witnesses have stated that the deceased was found wandering in drunken condition. Considering the aforementioned facts and circumstances and also that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Sahebpur Kamal P.S. Case No.159 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
