Heard Dr. Bidhu Ranjan, learned counsel for the petitioner and Dr. Indiwar Kumari, learned Counsel, for the opposite party.

Having considered the averments made in the application and having heard the learned counsel for the petitioner, we are satisfied that the absence of the petitioner and/or their counsel from the Court on 24.06.2016, was for reasons beyond their control.

In view of the above and in the interest of justice, the restoration application is allowed and Cr. Appeal (DB) No. 500 of

Patna High Court Cr.Misc. No.33129 of 2016 (2) dt.31-08-2016 2016 aforementioned is hereby restored to its original file. This Miscellaneous Case shall, accordingly, stand disposed of.
