ANJANA MISHRA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 23.07.2014 in connection with Kotwa P.S. Case No. 02 of 2014 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. It is submitted on behalf of the petitioner that the informant is the cousin brother of the petitioner, who is living with the uncle of the petitioner, who has no son and his property was owned by mother of the informant.

It is further submitted on behalf of the petitioner that there is history of land dispute between the parties and on this account the present petitioner has been implicated in the case.

Patna High Court Cr.Misc. No.47281 of 2014 (2) dt.04-02-2015 It is further submitted that there is a case and counter case wherein Kotwa P.S. Case No. 31 of 2014 has also been lodged by the co-accused Gauri Shankar Singh, who had also being named in the present case.

Considering the history of litigation between the parties and also the fact that there is a civil suit pending in the court below and other similarly situated persons have been granted privilege of bail, let the petitioner, above named be released on bail on furnishing bail bonds Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shree R.K. Bharti, Judicial Magistrate 1st Class, Sadar at Motihari in connection with Kotwa P.S. Case No. 02 of 2014. (Anjana Mishra, J.) Vats/- U T
