Mr.Sri Mritunjay Kumar Nirala ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Puraini P.S. Case No. 65 of 2016 registered under Section 395 of the Indian penal Code.
Earlier prayer of bail of the petitioner was rejected vide order dated 19.04.2018 passed in Cr. Misc. No. 9886 of 2018 and it appears that petitioner was apprehended on spot and one loaded pistol and cartridges were recovered from him. Submission of learned counsel for the petitioner is that he is in custody since 17.10.2016 and charge has been framed but up till now no witness has been examined.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,
Patna High Court Cr.Misc. No.74684 of 2018(2) dt.20-12-2018 2/2 be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned F.T.C.-II, Madhepura in connection with S.T.No. 61 of 2018 arising out of Puraini P.S. Case No. 65 of 2016 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned. The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
