====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Angarh P.S. Case No. 11 of 2018, CIS No. 853 of 2018 instituted for the offence under Section 302/34 of the Indian Penal Code. In the written report it is alleged that on 26.7.2018 at 6:30 p.m. informant reached to his house from the field and did not find her daughter in the house. The informant along with his family members started searching his daughter. During search, the informant found the dead body of his daughter in Jute (PATUA) field.

Counsel for the petitioner submits that petitioner is not named in the written report. His name has come in paragraph-4 of the case diary on the basis of statement of spy. Thereafter, the informant in her further statement in

Patna High Court Cr.Misc. No.72474 of 2018(2) dt.17-12-2018 2/2 paragraph-53 of the case diary has raised suspicion against this petitioner. Besides suspicion raised against the petitioner by the informant, there is no allegation of overt act against him. Petitioner is in custody since 4.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Angarh P.S. Case No. 11 of 2018, CIS No. 853 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
