2. Petitioner seeks regular bail in connection with Rail Kiul P.S. Case No. 92 of 2025 dated 12.05.2025 registered for the offences punishable under sections 8 and 20(b)(ii) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of 4.084 kg Ganja but the same is alleged to have been recovered from a backpack carried by co-accused Sikandar Kumar and the petitioner has been made accused mainly on the basis of the disclosure made by the apprehended co-accused, stating that the bag was handed over to him by this petitioner and the said statement comes in the purview of exculpatory statement and

No.55242 of 2025(2) dt.18-08-2025 2/3 further, the apprehended co-accused Sikandar Kumar revealed that he had come at the railway station to receive the seized contraband at the direction of one Kuldeep Choudhary and if these revelations made by co-accused are taken into consideration, then no role of this petitioner in transporting the alleged contraband appears and he had been made accused mainly on the basis of suspicion. It is further submitted that the petitioner is a young person and has been languishing in jail since 12.05.2025 and his past history is completely clean and the matter relates to the recovery of intermediate quantity of narcotic material and against this petitioner, the investigation has been completed. It is lastly submitted that nothing incriminating was recovered from the person of this petitioner to suggest any connection with the apprehended co-accused, Sikandar Kumar, except a sum of 1,180.

4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the petitioner's custody period, his young age as well as his profession and also completion of investigation against him, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail
