The petitioners apprehend their arrest in connection with Nanpur P.S. Case No.364 of 2021, registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is general and omnibus allegation against the petitioner. The specific allegation is against the son of petitioner no.1, Rakesh Mandal who abducted the minor girl of

Patna High Court CR. MISC. No.53259 of 2022(2) dt.14-12-2022 2/2 the informant. It is submitted that statement of the victim was recorded under Section 164 Cr.P.C. in which she has not supported the prosecution case.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Considering the facts that no specific overt act is alleged against the petitioners and the petitioners are father, mother and brother of the co-accused, Rakesh Mandal, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District Judge-VI, Sitamarhi in connection with Nanpur P.S.
