The petitioner is apprehending arrest in a case initially registered for the offences punishable under section 392 of the Indian Penal Code but subsequently converted into Sections 392, 395 and 120B of the Indian Penal Code. On robbing of the informant's wallet, mobile and Rs.4,000/- and motorcycle co-accused Ashok Aadav and Vikash Kumar @ Dablu were apprehended, who named the petitioner and others as member of gang. Subsequently, from co-accused Naresh Kumar, Guddu Mehta and Avinash Kumar, robbed motorcycle of the informant was recovered.
It is submitted by learned counsel for the petitioner that except the confession of the co-accused there is nothing
Patna High Court Cr.Misc. No.41327 of 2015 (2) dt.12-10-2015 2/2 against the petitioner. Moreover, statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Jamhore P.S. Case No.02 of 2014, pending before the learned CJM, Aurangabad.
With the above observation, this application is, accordingly, disposed off.
